Can maintenance be requested while the main claim is still pending?
Article 50 permits the court, where appropriate and on the entitled person’s request, to award temporary maintenance during a continuing-maintenance claim without the other party attending. Identify immediate needs and available support evidence in the request. This is a judicial interim decision, not an automatic payment resulting from opening a file.
Do spousal arrears and reimbursement of child expenses have the same look-back period?
No. Article 52 limits hearing a spousal-maintenance claim for a past period exceeding two years before filing. Article 59 sets a one-year limit for its specified reimbursement claim against the father and requires the payer’s intention to seek reimbursement when spending. These are different claims; identify the payer, beneficiary, dates and payment evidence. The law uses the Hijri calendar.
Does a child’s eighteenth birthday automatically end the father’s maintenance duty?
No. Article 58 ties a son’s maintenance to the ability of comparable people to earn, subject to its means conditions. Regulation Article 24 does not treat him as able to earn before eighteen and preserves ordinary successful completion of education. Article 22 also preserves support for a married daughter who does not qualify for spousal maintenance under Article 51. Review the actual dependency and education evidence.
What does Najiz require when a statement of claim is the appropriate route?
The Ministry requires the parties’ identity details and national address, plus a valid litigation power of attorney or guardianship document where relevant. In the Judiciary package, choose Statement of Claim, select the case classification, read its specific requirements, enter facts and parties, and attach the required documents. This does not bypass a mandatory preliminary process or mean every dispute uses the same claim category.
Does living separately automatically remove spousal maintenance?
No. Articles 51 and 55 must be read with the lawful-excuse qualification and Article 43. Maintenance rests on a valid marriage and the statutory conditions; an unjustified refusal of the specified marital living arrangements can affect it. Article 43 preserves maintenance while the wife properly awaits the due dower and suitable marital accommodation before moving in. Explain the reason for separation and available evidence, including safety concerns; do not assume that leaving a dangerous situation automatically forfeits support.
Is waiting-period maintenance the same after every form of marital dissolution?
No. Article 53 continues maintenance through the waiting period after revocable divorce, while an irrevocably separated woman receives it only if pregnant, until delivery. Article 54 treats bereavement differently: pregnancy support follows the rule about the unborn child’s funds and heirs, and the widow has a separate right to remain in the marital home during the waiting period. Establish the legal form and date of dissolution and pregnancy status; child maintenance and unpaid earlier spousal support are separate questions.
How is an interim maintenance award treated when continuing maintenance is decided?
Regulation Article 21 distinguishes beneficiaries. For a wife, the court considers the interim award when setting continuing maintenance, upward or downward, if either spouse requests that adjustment as applicable. For children or parents, continuing maintenance is calculated from its judgment date without counting the interim award into that calculation.
