Commercial case – claim reduction

How CounselO Reduced a SAR 500,000 Claim to SAR 227,000

CounselO was presented with a commercial claim in which the claimant sought SAR 500,000. After reviewing the case and analysing the documents, CounselO developed a defence strategy based on breaking down the claim and separating established amounts from compensation and damages requiring independent proof. In cooperation with the defendant’s legal representative, the case concluded with a judgment awarding only SAR 227,000—reducing the claim by SAR 273,000, or approximately 54.6%. The outcome was subsequently upheld on appeal.

The matter

Issue The issue concerned a commercial claim valued at SAR 500,000. The claimant relied on amounts previously paid and sought compensation for alleged damage and delays in performing the work. The question was whether the entire claim was actually established and payable, or whether the documents and evidence supported only part of it. Challenge The principal challenge was to prevent the claim amount from being treated as one fixed figure and instead break it down into separate elements: the principal amount, alleged damages, and additional compensation. Each element was then assessed for proof and entitlement. In cooperation with the legal representative, the defence focused on limiting liability to the amount that could actually be established. This ultimately reduced the claim from SAR 500,000 to SAR 227,000, with the result upheld on appeal.

Work performed

In this matter, we reviewed the SAR 500,000 commercial claim from the defendant’s perspective. CounselO’s team then broke the claim down into its component parts rather than treating it as one fixed amount. We analysed the principal amounts paid, the compensation claim, and the extent to which the alleged damage and its connection to performance were established, identifying what could actually be proved and what required independent supporting evidence. In cooperation with the defendant’s legal representative, we developed a defence strategy focused on limiting liability to the amount supported by the documents and challenging the additional unsubstantiated claims and compensation. The work continued through the appeal stage. The case concluded with a judgment awarding only SAR 227,000 instead of SAR 500,000—a reduction of SAR 273,000, or approximately 54.6%—with the judgment upheld on appeal. In brief: Case review → claim breakdown → evidence assessment → identification of actual financial exposure → defence strategy → cooperation with the legal representative → result upheld on appeal.

Outcome or value delivered

Result The work reduced the claim from SAR 500,000 to only SAR 227,000—a reduction of SAR 273,000, or approximately 54.6%. The judgment was then upheld on appeal, preserving the result achieved for the defendant. Value delivered CounselO’s value lay in not addressing the claim as one figure, but in breaking it down into separate elements and assessing each for proof and entitlement, while distinguishing the principal amount from the alleged compensation and damages. In cooperation with the legal representative, this approach helped limit liability to the amount that could actually be established, reduce the client’s financial exposure, and uphold the result before the Court of Appeal. In brief: The value was not limited to reducing the amount; it lay in redefining the scope of liability based on what the case file established, rather than what the opposing party claimed.
